Copyright Disclaimer

1. All artwork posted on jsnyderart.com is the sole property of JSnyderArt, LLC (hereafter referred to as "JSnyderArt") and all rights are reserved - this includes the rights to the images of sold and commissioned paintings, photography, prints or merchandise. JSnyderArt retains the right to make reproductions of any and all artwork created unless the collector has purchased the full or partial rights to the artwork in addition to purchasing the original.

2. The collector or buyer may not reproduce the artwork in any way without written permission. If the artwork ends up being reproduced in a publication or other media the work must be credited.

3. When an original painting or print is purchased, you, the collector, have the right to display the artwork in your home or business, but the artwork may not be reproduced without written permission from JSnyderArt. Unauthorized reproductions for sale are subject to litigation.

4. JSnyderArt actively pursues litigation against the unauthorized reproduction of copyrighted images at a rate of $100 per reproduction. JSnyderArt also employs active webcrawler services in order to identify theft of these images.

Commissioned Work

5. From time to time, JSnyderArt may offer commissioned work. The terms of any commission will be governed by the commission's specific contract. Without exception, 50% of the work's purchase price must be made as a nonrefundable deposit before work is to begin, in US funds. The remainder of the purchase price will be due and payable upon completion and prior to delivery. Failure to make the final contracted payment will result in forfeiture of both the commissioned work and 50% deposit. 

6. JSnyderArt does not provide any work in exchange for exposure or "on spec."

Gallery Display

7. JSnyderArt requires that any gallery displaying original work or merchandise, whether or not it is for the purpose of sale, to carry adequate independent insurance.

8. Galleries may have the option of contracting JSnyderArt to offer original work or merchandise with a promotional code or QR that provides a commission to the gallery upon completion of an online sale.

Web Design, Graphic Design and Photography

9. JSnyderArt offers both graphic design and photography services. All work is contracted in advance and requires a nonrefundable deposit. All process images provided are watermarked until the completion of the contract. Both JSnyderArt and client agree to predetermined due dates, and contracts unnecessarily delayed by the client's workforce (missed meeting, incomplete deliverables) will be billed at a contracted rate outside of total fees. No work is to be completed "on spec." 

10. Thumbnails, prototypes, concept sketches, notes and associated process documents remain the property of JSnyderArt

11. Unless contracted otherwise, JSnyderArt does not provide ongoing technical support for assets provided or training for asset management. 

12. If required, maintenance of third-party services, assets or software (PhotoShop subscriptions, web hosting fees, credit card processing fees, stock image fees) are the responsibility of the client.

13. Unless contracted otherwise, JSnyderArt does not provide edits or adjustments to assets after the completion of contracted work.

14. Unless contracted otherwise, completed web design, graphic design, and photography work may be used by JSnyderArt as portfolio content.

Donations

15. JSnyderArt does not provide finished works, services, or merchandise as a donation to "silent auction" fundraisers. Fundraising organizations may purchase these items at retail and auction them independently. As an alternative, organizations may contract JSnyderArt to provide a previously agreed-upon portion of sales for the retail price of items that are promoted by the organization.

Third Party Terms

16. Items purchased through third party sites are subject to that site's Terms of Use.
